Terms and Conditions for Waste Removal London Services
These Terms and Conditions set out the basis on which Waste Removal London provides waste collection and related services to domestic and commercial customers. By booking a collection or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.
1. Definitions
In these Terms and Conditions, the following expressions have the following meanings:
Customer means the person, company or organisation that requests or pays for the services provided by Waste Removal London.
Services means any waste collection, removal, clearance, loading, transportation, recycling, disposal or related services provided by Waste Removal London.
Waste means any items, materials, rubbish, refuse, junk, furniture, appliances, garden waste, construction or commercial waste or other items agreed to be collected under the Services, excluding any prohibited items as set out in these Terms and Conditions.
Agreement means the contract between Waste Removal London and the Customer for the provision of Services, consisting of these Terms and Conditions and the details confirmed at the time of booking.
2. Scope of Services
Waste Removal London provides waste collection and removal services for households and businesses within its operational service area. The exact nature of the Services, including type of waste, approximate volume, access conditions and collection date, will be agreed at the time of booking.
Services may include, as agreed with the Customer, loading of waste from the property, garden or other accessible areas; removal and transportation of waste; and delivery of waste to licensed facilities for recycling or disposal in compliance with applicable waste regulations.
Waste Removal London reserves the right to refuse to provide Services in respect of any waste it reasonably considers to be hazardous, prohibited, unsafe to handle, or in breach of relevant laws or regulations.
3. Booking Process
The Customer may request a booking by phone or email, providing accurate details of the type and approximate quantity of waste, the collection address, access information and preferred date and time window for collection.
Any quotation provided prior to on-site inspection will be an estimate only, based on the information supplied by the Customer. Waste Removal London may revise the quotation upon arrival if the actual volume, type or condition of waste, or the access to the property, differs from that described by the Customer at the time of booking.
A booking is only confirmed when Waste Removal London has accepted the order and communicated confirmation to the Customer. Waste Removal London reserves the right to decline or cancel any booking where it is not reasonably practicable or lawful to perform the Services.
4. Access and Customer Responsibilities
The Customer must ensure that Waste Removal London has safe, reasonable and unobstructed access to the waste at the agreed time. This includes arranging any necessary permissions, parking, building entry or lift access and ensuring that the waste is not obstructed by locked gates, vehicles or other objects.
The Customer is responsible for providing accurate information regarding access conditions, including any restrictions on vehicle size, parking limitations, loading times or site-specific safety requirements. Additional charges may apply if collections are delayed or extended due to inadequate access information or obstructions.
If the Services involve entry to internal areas of a property, the Customer must ensure that the areas are safe, reasonably tidy and free from undue hazards. Waste Removal London may refuse to carry out the Services or may adapt the Services where it deems conditions to be unsafe.
5. Waste Types and Prohibited Items
The Customer must clearly identify the waste to be collected and may be asked to separate certain waste streams as directed by Waste Removal London. The Services do not include the collection of hazardous or specialist waste such as asbestos, clinical or medical waste, chemicals, solvents, pressurised gas cylinders, explosives, radioactive materials, or any waste classified as hazardous under relevant legislation unless expressly agreed in writing in advance.
Waste Removal London may refuse to collect any items it reasonably believes to be hazardous, contaminated, infested, excessively heavy, unsafe to move, or not in accordance with the description given at the time of booking. If prohibited or hazardous items are discovered during a collection, Waste Removal London may charge for any additional time on site, safe segregation or aborted collection.
6. Pricing and Quotations
Prices for the Services are generally based on factors such as the volume and weight of waste, the type of materials collected, loading time, labour required, and accessibility. Where possible, an estimate will be provided in advance. However, the final price will be confirmed on-site once the crew has inspected the waste and access conditions.
All prices quoted are exclusive of any applicable taxes unless otherwise stated. Waste Removal London reserves the right to amend prices at any time before a booking is confirmed. Any changes to pricing after a booking has been confirmed will require the Customer's agreement before the Services proceed.
If during the provision of the Services it becomes evident that the volume of waste or the work involved is significantly greater than anticipated, Waste Removal London may adjust the charge accordingly. The Customer will be informed and may decide whether to proceed with the revised charge or to reduce the scope of the collection.
7. Payments and Invoicing
Unless otherwise agreed in writing, payment is due immediately upon completion of the collection, and in any event before the vehicle leaves the site. Payment may be made by debit card, credit card, bank transfer or other methods accepted by Waste Removal London from time to time.
Commercial Customers who have been granted credit terms will receive an invoice following completion of the Services. Payment must be made in full within the agreed credit period, typically 7, 14 or 30 days from the date of the invoice, as specified on the invoice.
Waste Removal London reserves the right to charge interest on late payments at the statutory rate permitted under applicable law, accruing daily from the due date until payment is received in full. The Customer will also be liable for all reasonable costs incurred in recovering overdue sums, including administrative costs and legal fees.
8. Cancellations and Amendments
The Customer may cancel or amend a booking by giving reasonable notice to Waste Removal London. Where possible, at least 24 hours notice prior to the scheduled collection time should be provided to avoid cancellation charges.
Waste Removal London reserves the right to charge a fee if the Customer cancels a confirmed booking with less than 24 hours notice or if the crew attends the site but is unable to complete the collection due to circumstances within the Customer's control, such as lack of access, insufficient parking, or the waste not being available as described.
If Waste Removal London needs to cancel or reschedule a booking due to operational reasons, vehicle breakdown, staff illness, severe weather or other events beyond its reasonable control, it will notify the Customer as soon as practicable and offer an alternative date or time. Waste Removal London will not be liable for any indirect or consequential losses arising from such cancellations or delays.
9. Service Performance and Time Slots
Any collection times or time windows provided are estimates only. While Waste Removal London will make reasonable efforts to attend within the agreed time, it does not guarantee that collections will take place at an exact time, due to factors such as traffic, previous jobs overrunning, or unforeseen circumstances.
The Customer must ensure that someone authorised is available on site during the agreed time window to provide access and confirm the waste to be collected. If no authorised person is present or if access is not available, the collection may be aborted or delayed, and additional charges may apply.
10. Title and Risk in Waste
Once the waste has been loaded onto a Waste Removal London vehicle and any applicable payment has been made, title to the waste passes from the Customer to Waste Removal London. Risk of loss or damage in the waste passes to Waste Removal London at the same time.
Until title and risk pass, the Customer remains responsible for the waste and must ensure that it is stored safely and in compliance with any applicable regulations.
11. Compliance with Waste Regulations
Waste Removal London operates in accordance with applicable UK waste management legislation and guidance, including requirements relating to licensing, transfer notes and duty of care. Waste collected will be transported only to appropriately licensed or permitted facilities for recycling, recovery or disposal.
The Customer agrees to cooperate with Waste Removal London in providing any information reasonably required to complete waste documentation, including the description and origin of the waste. Where necessary, Waste Removal London may issue or request a waste transfer note or similar documentation, and the Customer must provide accurate information for this purpose.
The Customer warrants that the waste presented for collection is not hazardous unless previously declared and agreed, and that it is lawfully in the Customer's possession or control. The Customer will indemnify Waste Removal London against any loss, liability, fines or expenses arising from misdescription, contamination or illegal disposal of waste that originates from the Customer.
12. Customer Warranties and Indemnities
The Customer warrants that they have full authority to arrange the removal of the waste and that the waste does not include any items belonging to third parties that the Customer is not entitled to dispose of. The Customer is responsible for ensuring that no items of value are included in the waste.
The Customer agrees to indemnify and hold harmless Waste Removal London, its employees and agents from and against all claims, liabilities, damages, losses, costs and expenses arising out of or in connection with any breach by the Customer of these Terms and Conditions, including but not limited to misrepresentation of the nature or ownership of the waste or failure to obtain necessary consents.
13. Liability and Limitations
Waste Removal London will exercise reasonable care and skill in providing the Services. However, the Customer acknowledges that minor scuffs or marks can occasionally occur during the removal of bulky items, and Waste Removal London will not be liable for cosmetic damage to walls, floors, fixtures or fittings that is reasonably incidental to the performance of the Services, provided that reasonable care has been taken.
Nothing in these Terms and Conditions limits or excludes Waste Removal London's liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be lawfully excluded.
Subject to the foregoing, Waste Removal London will not be liable for any loss of profits, loss of business, loss of goodwill, or any indirect or consequential loss arising out of or in connection with the Services. Waste Removal London's total aggregate liability to the Customer for all claims arising out of or in connection with the Agreement shall not exceed the total amount paid or payable by the Customer for the specific Services giving rise to the claim.
14. Events Beyond Our Control
Waste Removal London will not be in breach of the Agreement or otherwise liable for any delay in performing, or failure to perform, any of its obligations where such delay or failure results from events, circumstances or causes beyond its reasonable control. These may include, but are not limited to, severe weather, traffic incidents, accidents, breakdowns, strikes, lock-outs, power failures, acts of government or public authorities, or other force majeure events.
15. Complaints
If the Customer is dissatisfied with any aspect of the Services, they should contact Waste Removal London as soon as possible, providing details of the collection, the nature of the complaint and any supporting information. Waste Removal London will investigate the issue and, where appropriate, may offer a remedy such as a partial refund, re-attendance or other corrective action.
Any complaint relating to visible damage or service performance should be reported within a reasonable time after the collection, and in any event not later than 7 days from the date on which the Services were provided.
16. Data Protection and Privacy
Waste Removal London will collect and process personal data from Customers in order to manage bookings, provide the Services, handle payments and communicate regarding collections. Personal data will be processed in accordance with applicable data protection laws and used only for legitimate business purposes, including administration, accounting, customer service and legal compliance.
By providing personal information, the Customer consents to its use for these purposes. Waste Removal London will take reasonable steps to keep personal data secure and will only share it with third parties where necessary to provide the Services, fulfil legal obligations or with the Customer's consent.
17. Variation of Terms
Waste Removal London may amend these Terms and Conditions from time to time. Any updated terms will apply to new bookings made after the date on which the revised terms are published or otherwise made available to Customers. The terms in force at the time of booking will apply to that particular Agreement.
18. Severability
If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms and Conditions, together with the booking confirmation and any agreed written variations, constitute the entire agreement between Waste Removal London and the Customer in relation to the Services and supersede any prior understandings, representations or agreements, whether oral or written.
20. Governing Law and Jurisdiction
These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Services shall be governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.
